06. Routes to secure specified skilled workers
(1) Accepting foreign nationals residing in Japan
- Employ individuals who are expected to successfully complete Technical Intern Training (ii), individuals who are expected to successfully complete Technical Intern Training No. 3, or foreign construction workers.
- Employ foreign students and others who have passed both skills evaluation exam and the Japanese language test.
(2) Accepting foreigners coming to Japan from overseas
- Employ those who have successfully completed Technical Intern Training (ii) and returned to their home countries (including those who have successfully completed Technical Intern Training (ii) and returned to their home countries with experience as Technical Intern Training No. 3 or Foreign Construction Workers).
- Hire foreigners who have passed both skills evaluation exam and the Japanese language test.

Currently, foreign nationals residing in Japan with a residence status of "Technical Intern Training" or "Designated Activities" (foreign construction worker) can apply for permission to change their residence status without temporarily returning to their home country.
It is prohibited to engage in malicious poaching practices, whether direct or indirect, against foreign nationals employed by other businesses.

14. Accepting companies will maintain a good working environment and provide appropriate treatment while maintaining close communication with specified skilled workers on a daily basis so that they can effectively utilize their abilities. They will also refrain from malicious poaching of foreign nationals employed by other businesses, whether directly or indirectly.
Regardless of whether they are Japanese or foreign, construction workers cannot be referred by paid employment placement agencies. Receiving the introduction of foreigners in exchange for payment is a violation of the Employment Security Law. In the case of (2) 1) above, it is assumed that in many cases foreigners who were employed by the company in the past are re-employed, but there is no problem if they have not received paid employment placement services.
Before implementing The Specified Skills (i) Evaluation Exam for Construction Industry overseas, JAC will conduct a job search survey among regular member construction trade associations and supporting member construction companies. After that, we will conduct a job search survey and match foreigners who have passed both skills evaluation exam and the Japanese language test with employment.
