Chapter 2
08. specified skilled worker employment contracts Points (1)
(2) specified skilled worker employment contracts points
When concluding a specified skilled worker employment contracts, it is required for the Specified Skilled Worker (i) to "pay a stable amount of remuneration equal to or greater than that of a Japan person with equivalent skills, and to increase salary in the case of skill mastery, and to clearly state this in the specified skilled worker employment contracts" (Article 3, Paragraph 3, Item 2 of the Notice). We will explain each in detail.
1) Amount of Remuneration
Specified Skilled Worker (i) is necessary to be treated as a person with appropriate experience because they already have a certain level of experience or skills, just like those who have completed the Technical Intern Training (ii) well. Specifically, it is necessary to treat those who have passed the The Specified Skills (i) Evaluation Exam for Construction Industry or those who have passed the skill test level 3 as those with more than 3 years of experience.
Therefore, when determining the expected amount of compensation, it is necessary to set an appropriate amount of compensation by comparing it with the compensation paid to Japan technicians with the actual experience of the Specified Skilled Worker (i), as well as exceeding the level of compensation of the Technical Intern Training (ii).
In the Specified Skilled Worker Acceptance Plan in the construction field certification examination conducted by each regional development bureau of the Ministry of Land, Infrastructure, Transport and Tourism, from the perspective of thoroughly enforcing the principle of equal or more amounts with Japan with equal skills, uneven distribution of Specified Skilled Worker in areas with high wages, and easing concentration, the estimated amount of remuneration will be examined compared to the following (1) to (3), and if it is judged to be low, it will be instructed to raise it. In that case, please note that the receiving company will need to change the expected amount of remuneration and then explain the important matters related to the specified skilled worker employment contracts and go through the procedures for concluding the specified skilled worker employment contracts again.
