(2) Key points of Specified Skills employment contracts
When concluding Specified Skills employment contract, it is necessary to "stablely pay Specified Skilled Worker (i) at least the same amount of remuneration as a Japanese national with equivalent skills would receive, and to provide wage increases as the skills improve, and to clearly state this in the Specified Skills employment contract" (Notification Article 3, Paragraph 3, Item 2). We will explain each of these in detail.
1) Amount of Remuneration
Since Specified Skilled Worker (i), like those who have successfully completed Technical Intern Training (ii), already have a certain level of experience or skills, it is necessary to treat them as people with appropriate experience. Specifically, those who have passed The Specified Skills (i) Evaluation Exam for Construction Industry or Level 3 Skill Test must be treated as people with more than three years of experience.
For this reason, when determining the expected remuneration amount, it is necessary to not only exceed the remuneration level for Technical Intern Training (ii), but also to set an appropriate expected remuneration amount by comparing it with the remuneration actually paid to Japanese skilled workers with experience equivalent to the Specified Skilled Worker (i) in question.
In the certification review of the construction Specified Skills acceptance plan conducted by each regional development bureau of the Ministry of Land, Infrastructure, Transport and Tourism, the planned remuneration amount will be reviewed by comparing it with the following ① to ③ from the viewpoint of thoroughly enforcing the principle of paying at least the same amount as Japanese people with equivalent specified skilled workers skills foreigners in areas with high wages, and if it is judged to be low, it will be instructed to raise it. In that case, please note that the accepting company will need to change the planned remuneration amount and go through the procedures for explaining important matters related to Specified Skills employment contract and concluding Specified Skills employment contract again.
