03. How can we secure Specified Skilled Worker (i)?

The accepting company must enter into a Specified Skills employment contract with the "foreigner residing in Japan" or "foreigner coming to Japan from overseas."

"Foreigners residing in Japan" are primarily considered to be those who fall under the following categories:

①Those who are expected to successfully complete Technical Intern Training (ii)
②Those who are expected to complete Technical Intern Training No. 3
③ Foreign students who have passed both skills evaluation exam and the Japanese language test

Foreigners who are currently undergoing technical intern training and have not yet completed their technical intern training plan are not permitted to change their status of residence to "Specified Skills" due to the nature of their "technical intern training" status. However, applications for certification of construction Specified Skills acceptance plans can be made six months before the expiration date of their "technical intern training" status of residence. In addition, foreign construction workers can change their status of residence to "Specified Skills" by completing the necessary procedures without waiting for the expiration date of their "specified activities" status of residence. Foreigners currently residing in Japan with "technical intern training" or "specified activities" status of residence (foreign construction workers) can apply for permission to change their status of residence without returning to their home country temporarily.

The total number of Specified Skilled Worker (i) and the total number of Foreign Construction Workers must not exceed the total number of full-time employees of the construction company that accepts Specified Skilled Worker (i). In other words, the total number of Specified Skilled Worker (i) and the total number of Foreign Construction Workers can be up to the total number of full-time employees of the accepting company.

You do not need to be a member of JAC when posting a job offer for specified skilled workers. However, in order for a job seeker to work as Specified Skills, you need to apply for an acceptance plan to the Ministry of Land, Infrastructure, Transport and Tourism. You must be a member of JAC at that point. Therefore, if there is a possibility that the person you plan to introduce will not be able to work with Specified Skills residence status immediately, it will be a disadvantage for job seekers who want to work with Specified Skills, and they may not choose your company, so please consider joining a regular member organization that is a construction industry association in a planned manner. Becoming a member of a regular member organization that is a construction industry association will not only contribute to the healthy development of the construction industry as a member of a construction industry association that supports the Japanese construction industry, but also for the sake of Specified Skills.

It depends on the time and the type of job. Job offers can be withdrawn at any time, so if you are already in a position to accept foreigners, you can still post a job offer.
