01. New Certification Conditions
Regarding new certification conditions for the Construction Specified Skills Acceptance Plan


(1) Having a construction business license (license under Article 3, Paragraph 1 of the Construction Business Law)
(2) Your business registration must be completed in Construction Career Up System (if you are currently applying for registration, you cannot apply).

(3) Belong to Japan Association for Construction Human Resources or a construction trade association that constitutes the said corporation, and comply with the code of conduct. (Applications cannot be made if the application for membership is in progress.)

(4) The applicant has not received any supervisory action under the Construction Business Act within the five years prior to the application
In addition, the company has not received any supervisory action based on the Construction Business Law since the application date (certification date).
(5) The company is recruiting full-time employees in the same occupation as specified skilled workers (recruiting personnel through Hello Work).
(6) The number of specified skilled workers in construction does not exceed the number of full-time employees.

(7) Treatment of specified skilled workers should be equal to or better than that of permanent full-time employees.
(8) After accepting specified skilled workers, provide them with Safety and Health Education such as special training based on the Industrial Safety and Health Act.
(9) After accepting specified skilled workers, efforts should be made to improve their skills with a view to their five-year period of stay.

(1) Registration for Specified Skills Construction Career Up System for foreigners must be completed (if registration is pending, you cannot apply)
(2) The work to be done by specified skilled workers is in the construction industry.
If a foreign national who is to become Specified Skills is "living overseas" or "currently working for another company and has not yet obtained an ID," he or she must apply for skilled worker registration after starting work at the application company, and once a skilled worker ID is issued, he or she must promptly register the skilled worker ID in the employment management system.

(3) The correspondence between the work classification of specified skilled workers and the examinations that the foreign national needs to pass and the technical intern training, etc. that the foreign national has completed is appropriate.

(4) To steadily pay specified skilled workers wages equal to or greater than those paid to Japanese nationals with equivalent skills.*
*Stable payment means "a monthly salary system" and "payment method is transfer to a savings account."

(5) Providing pay raises for specified skilled workers in accordance with their skill proficiency
*Even if Japanese workers do not receive a raise, specified skilled workers are required to receive a raise.

(6) The important matters are explained to foreign residents in advance in a manner that satisfies the requirements for certification by the Ministry of Land, Infrastructure, Transport and Tourism.
It is also necessary to write the document in a language that the other party can fully understand (such as their native language).

(7) An employment contract for Specified Skills is concluded with a foreign national under the conditions that satisfy the important matters advance explanation and the conditions certified by the Ministry of Land, Infrastructure, Transport and Tourism.
