- Does the three categories of "civil engineering," "architecture," and "lifelines and facilities" cover all construction work?
-
Article 2, paragraph 1 of the Construction Business Law defines "construction work" as "construction related to civil engineering and architecture that is listed in the upper column of Attached Table 1," and the table lists 29 types of construction work that can be carried out with a license as a construction business. The three categories are stipulated to cover all specialized work related to these 29 types of construction work.
- For those who are already specified skilled workers, do they need to complete various procedures at the Ministry of Land, Infrastructure, Transport and Tourism and the Immigration Services Agency (Immigration Bureau)?
-
For specified skilled workers who have a residence status of Specified Skilled Worker (i) before the classification integration, they will automatically be converted to the new classification after the classification integration, so no procedures are required unless there is a change (including addition) to the job type or work they are engaged in. If you add or change the job type or work they are engaged in, you will need to raise their salary so that they are paid at least as much as Japanese people with the same skills for the job type or work they are engaged in, so you will need to enter into a new employment contract or enter into a contract to change the basic wage, and then submit a notification of the change in basic wage on the foreign national employment management system.
For example, if specified skilled workers who has only been doing scaffolding work is to be assigned to concrete pumping and construction machinery installation, he or she must be treated the same as a Japanese worker with equivalent skills, so the employment contract must be changed (salary increase) and a notification of change to the acceptance plan must be filed.
- Will overseas training be offered under the new system?
-
We plan to consider courses and other measures to improve skills together with specialized construction industry associations, which are full member organizations.
- Can I employ a foreigner who has completed waterproofing training as specified skilled workers?
-
Those who have successfully completed Technical Intern Training (ii) in waterproofing construction can apply for an acceptance plan. The application will be classified as "construction."
- Does the waterproofing organization now issue membership cards?
-
The National Waterproofing Contractors Association will issue a membership certificate.
- There are workers who have four years of experience in the technical intern training occupation but have almost no experience in other occupations. If they are employed as specified skilled workers, will their salary be equivalent to that of a fourth-year worker?
-
Yes. In the same work category, they are considered to have the same skills and experience, so the remuneration must be equal to or greater than the remuneration paid to a Japanese skilled worker with about four years of experience.
- Even with the new work classification, if I pass the skills test for the corresponding occupation, can I still meet the requirements to become Specified Skills?
-
Yes, you can obtain the requirements to become Specified Skills.
- Can I continue to move from technical intern training to Specified Skills as before?
-
As before, those who have completed the technical intern training program that is eligible for transfer can transfer to the corresponding Specified Skills without taking any additional exams, etc. If they wish to transfer to a work category other than the corresponding Specified Skills, they will need to take a separate exam for the work category to which they wish to transfer.
- What type of jobs will foreigners currently working as Specified Skills be transferred to under the new system?
-
the table below.Please check
- For example, can specified skilled workers who is already working in "formwork construction" also work in "rebar construction," which is included in the same category under the new classification?
-
There is no problem as both "formwork construction" and "rebar construction" are job types in the same work category of "civil engineering" and "architecture".
In that case, they must be treated the same as Japanese people with equivalent skills, so the employment contract must be changed (salary increase) and a notification of change to the acceptance plan must be filed.
- For example, if a technical intern trainee in "painting" becomes specified skilled workers in the construction category, can he or she really be allowed to do "interior finishing" work in the construction category?
-
Even if the work content is completely different, as long as it is classified as the same, employees can still be employed under the system. It is possible to expand the range of work that employees can be engaged in by providing training within the company, etc.
- If my occupation is formwork construction and the exam category applies to both civil engineering and architecture, which category should I take if my occupation covers multiple areas?
-
Please check the job types included in each category and make your selection based on what kind of work you would like to do in the future.
